The Role

Moderna is seeking a Counsel, Sales and Marketing to take responsibility for providing legal support for the commercialization of the Moderna COVID-19 Vaccine in the U.S. and, over time, other assets transitioning to commercialization in the United States. This position will be the primary point of contact for the U.S. Marketing and U.S. Sales teams.

Here's What You'll Do

  • Provide significant product support as a brand lawyer with expertise advising on both promotional and non-promotional initiatives
  • Serve as the primary legal advisor on commercial activities involving Moderna's COVID-19 vaccine in the US market, with a strong focus on advising on advertising, promotion, and sales
  • Provide legal advice on FDA regulatory law (Food, Drug, and Cosmetic Act) and fraud and abuse laws and regulations (Anti-Kickback Statute, False Claims Act) for strategies and tactics related to commercialization
  • Review business materials (e.g., brand plans, marketing proposals, sales training materials) requiring legal input and provide solutions-oriented advice to internal clients
  • Serve as the primary legal representative on the promotional materials review committee
  • Advise on sales- and marketing-related partnerships and services with third parties, and provide advice on contracting related to these activities to the business and procurement teams
  • Serve as primary legal point of contact for the head of U.S. sales and his or her organization
  • Collaborate with Compliance to identify, develop and deploy necessary policies and training for the customer-facing account management and sales teams
  • Engage with cross-functional teams (e.g., Medical Affairs, Communications, Regulatory, Commercial Operations, Market Access) to develop consistent, compliant strategies to meet business needs
  • Serve as business partner while also providing clear legal advice that communicates the magnitude of legal risks and identifies decision rights

Here's What You'll Need (Minimum Qualifications)
  • Juris Doctor and admitted to the bar in good standing in at least one jurisdiction
  • 8+ years of experience in-house or at a law firm supporting the pharmaceutical or biotech industry required
Here's What You'll Bring to the Table (Preferred Qualifications)
  • Experience advising on FDA promotional rules, regulations and guidance
  • Experience counseling and/or litigating on industry specific fraud and abuse laws (Anti-kickback Statute, False Claims Act)
    • Experience with industry privacy laws and regulations (HIPAA, TCPA, CAN-SPAM) a plus
  • Ability to perform legal analyses and counsel business partners independently, with a focus on delivering solutions-oriented advice
  • Excellent communication, presentation, collaboration and influencing skills across internal and external stakeholders
  • Intense sense of urgency, curiosity, and ambition to excel and build something from the ground up, navigating all the requisite ambiguity and complexity that comes with writing the rulebook while executing in real time
